Terms and conditions for Toyota GB Better Cricket Competition 2016

  1. The Promoter is Toyota (GB) PLC, registered in England & Wales with company number 0916634 and with its registered office at Great Burgh, Burgh Heath, Epsom, Surrey, KT18 5UX.
  2. The title of the competition is ‘#bettercricket’ (the “Competition”) and involves the general public submitting an idea for how the game of cricket can be improved through innovation (the “Cricket Idea”).
  3. The Competition will run from 3:00pm on 16th May 2016 to 11:59pm on 11th June 2016 (the "Closing Date") inclusive. Any Entries received after the Closing Date will not be accepted and automatically disqualified.
  4. To enter the Competition (an “Entry” or “Entries”), submit your Cricket Idea via:
    • (i) the online form provided on https://www.toyota.co.uk/cricket (the “Website”); or
    • (ii) Twitter by tweeting the Cricket Idea to @TOYOTAGB and including #bettercricket
  5. The Promoter will not accept:
    • (i) responsibility for Entries that are lost, mislaid, damaged or delayed in transit, regardless of cause, including, for example, as a result of any postal failure, equipment failure, technical malfunction, systems, satellite, network, server, computer hardware or software failure of any kind; or
    • (ii) proof of posting or transmission as proof of receipt of Entry; or
    • (iii) any entries made via Facebook including any Cricket Idea posted on the Toyota GB Facebook page or posted as a status update.
  6. By submitting an Entry, you are agreeing to accept and be bound by all these terms and conditions and all Twitter’s rules and policies https://support.twitter.com/articles/18311-the-twitter-rules.
  7. All Entries will be judged in two stages:
    • (i) Three Entries will be selected by the first panel of independent judges (the “Shortlist”); and announced on the Website and Toyota social channels by 16th August 2016
    • (ii) A winner will be selected from the Shortlist (the “Winner”) by a second panel of independent judges (who will consist of different judges than the first panel) at an event which will be held between 31th August and 25th September 2016 (the “Event”).
  8. All Entries will be judged on the following criteria for the Shortlist selection:
    The Cricket Idea must:
    • (i) showcase a new or inventive use of technology to improve cricket;
    • (ii) have innovation at the core of its concept;
    • (iii) be able to be feasibly developed and enhanced by the Promoter’s in-house expertise (considering factors including but not limited to cost, product design, technology and engineering); AND
    • (iv) have a clear role or benefit to cricket at any level (international down to grass roots).

    The decision of the Judges (acting reasonably) will be final and no correspondence or discussion will be entered into. A list of names of the Judges is available on request.

  9. The public will be able to vote for the winner (the “Competition Winner”) from the Shortlist on the Website between 16th August and 31st August 2016 (the “Voting Period”). Any member of the public that votes during the Voting Period will be entered into a prize draw to win a cricket bat signed by all members of the England cricket team (the “Prize Draw Winner”). The Prize Draw Winner will be chosen at random and will be notified after the Voting Period using the email address provided.
  10. The Competition Winner will be announced after the Voting Period on the Website. The Promoter will contact the Competition Winner personally as soon as practicable after the end of the Voting Period, using the email address provided with the Competition Entry or via direct mail on Twitter. If the Promoter cannot contact the Winner via the details or account provided at entry or if the Winner does not return necessary details within 14 days, the Promoter reserves the right to award the Prize to the next Competition Winner as voted for during the Voting Period.
  11. There shall be one prize (the “Prize”) consisting of:
    • (i) Meet and greet with an England International cricket player;
    • (ii) A full sized cricket bat signed by current members of the England cricket team. The Promoter cannot guarantee that all members of the team will have signed the bat;
    • (iii) A pair of tickets to the England v Pakistan Royal London One Day International on Sunday 4th September 2016; and
    • (iv) The opportunity to be involved with the Promoter and the England and Wales Cricket Board to work on product and concept development to explore whether the winning idea can be implemented into the game of cricket.
  12. The Prize is as described at time of publication, non-transferable, non-refundable, non-changeable and must be accepted as offered. Cash or credit alternatives for the Prize will not be offered. The Promoter reserves the right to substitute the Prize should the specified Prize become unavailable for any reason.
  13. The Competition is only open to permanent residents in Great Britain aged 18 years or over, except:
    • (i) employees of the Promoter or its holding or subsidiary companies;
    • (ii) employees of agents or suppliers of the Promoter or its holding or subsidiary companies, who are professionally connected with the Competition or its administration;
    • (iii) members of the immediate families or households of (i) and (ii) above; or
    • (iv) anyone else professionally associated with the Competition.
  14. In entering the Competition, you confirm that you are eligible to do so and eligible to claim the Prize. The Promoter may require you to provide proof that you are eligible to enter the Competition.
  15. The Promoter will not accept Entries that are automatically generated by computer, completed by third parties or in bulk, illegible, have been altered, reconstructed, forged or tampered with or incomplete.
  16. There is a limit of one Entry per person. Entries on behalf of another person will not be accepted and joint submissions are not allowed. The Entries will not be returned.
  17. The Promoter reserves all rights to disqualify you if your conduct is contrary to the spirit or intention of the Competition. Any comments or photos that we consider (in our absolute discretion) to be vulgar, offensive, indecent, racist, copied, offensive, cruel or fraudulent, or infringe on the rights or others will be immediately removed.
  18. Insofar as is permitted by law, the Promoter, its agents or distributors will not in any circumstances be responsible or liable to compensate the Winner or accept any liability for any loss, damage, personal injury or death occurring as a result of taking up the Prize except where it is caused by the negligence of the Promoter, its agents or distributors or that of their employees. Your statutory rights are not affected.
  19. All Entries and any accompanying material submitted to the Promoter will become the property of the Promoter on receipt and will not be returned.
  20. By submitting your Entry and any accompanying material, you agree to assign to the Promoter all your intellectual property rights with full title guarantee and waive all moral rights in and to your Entry and otherwise arising in connection with your Entry to which you may now or at any time in the future be entitled under the Copyright, Designs and Patents Act 1988 as amended from time to time and under all similar legislation from time to time in force anywhere in the world.
  21. If you are included in the Shortlist or the Winner of the Competition, you agree that the Promoter may use your name, image and town or county of residence to announce the Shortlist and the Winner of this Competition and for any other reasonable and related promotional purposes. You further agree to participate in any reasonable publicity required by the Promoter.
  22. By entering the Competition, you agree that any personal information provided by you with the Entry may be held and used by the Promoter or its agents and suppliers:
    1. to administer the Competition;
    2. To be contacted by the Promoter in the future about new vehicle launches, competitions and events and opportunities for drivers, such as track days or Toyota GB experiences. Further details of how the Promoter may use the information provided by you and how you may opt out of receiving any further correspondence from the Promoter can be found online at www.toyota.co.uk in its Privacy Policy.
  23. By entering the Competition, you agree that if your Cricket Idea is selected for the Shortlist, you may be requested by the Promoter to attend the Event. The Event will be filmed and used as a promotional tool for the Competition (the “Film”). You agree to grant the Promoter a free, worldwide perpetual licence to use your name, face, voice and performance (including the sound recording of your voice/performance and written versions of the comments made as part of your performance whether in whole or in part in any context) in any media it wishes in the Film for the purposes of promoting the Competition and the Cricket Idea.
  24. If there is any reason to believe that there has been a breach of these terms and conditions, the Promoter may, at its sole discretion, reserve the right to exclude you from participating in the Competition.
  25. The Promoter reserves the right to hold void, suspend, cancel, or amend the Competition where it becomes necessary to do so at any stage and without notice if deemed necessary in their opinion, and/or if circumstances arise outside of their control. The Promoter (and those organising any prize on their behalf) cannot be held responsible or liable for any circumstance beyond its reasonable control that prevents the Prize from being available.
  26. The Promoter reserves the right to amend these Terms and Conditions at any time. The Promoter will ensure to publish the amended Terms and Conditions appropriately.
  27. No purchase or entry fee necessary.
  28. These terms and conditions shall be governed by English law, and the parties submit to the exclusive jurisdiction of the courts of England and Wales.
  29. This Competition is in no way sponsored, endorsed or administered by, or associated with, Facebook and/or Twitter. By entering, you acknowledge that Facebook and/or Twitter bear no responsibility for this Competition and you fully and completely release Facebook and/or Twitter from any liability whatsoever arising out of the Competition. The use of the #bettercricket hashtag provided should only be used on relevant updates.
